Daily Wire Jewelry Making Tip

Question:

You have often said that your patterns are free for us to make and sell. Does that hold true for all jewelry patterns, such as those in magazines, or does copyright keep us from selling the designs of other people?

Answer:

Although this is a repeat question, I think it is important to address again, as we do have new people here every day. Please follow this link for the answer and comments: Permission for Selling Jewelry Made With Wire-Sculpture Patterns and thanks so much for asking!

If someone publishes a piece in a magazine, they have to know someone will duplicate it, or rework it and make it for themselves. I simply will not bother to copyright any design, as it is just too hard to actually copyright one and make it stick. You are the one who has to defend the copyright, after all, and that is expensive; the court is not going to do it for you, and if you were to actually win, you would find yourself suing a person with no more resources than you yourself have.
If I pattern something after a flower, how can I copyright that? I mean, I can, but that flower is likely seen by many more people than I, and it is just not realistic to copyright a flower…

Thanks for the answer to a very delicate question. I, like so many other jewelry makers, have often wondered this same question. Even though you have helped to clear this up, I still will not make anything the “same” and will remember to give credit for the “inspiration”.
